Comment on the decision of 11 June 2014, HC, Charalambous v. Republic, Presentation and comment on the decision on the constitutionality or not of the Law on Extraordinary Contribution of Officials, Employees and Pensioners of the State Service

Augi Neofitou

As has been said by Supreme Court Justice Nicolatos, the present case "is one of the most important cases brought before the Full Bench of the Supreme Court in recent years. In this case, on the one hand, there is a question of the restriction of human rights, constitutionally guaranteed, and on the other hand, there is a question of the dire financial situation in which the State finds itself, which threatens its foundations and jeopardizes its future. The Constitutional Judge, therefore, is the judge of the legality and constitutionality of the measures taken by the State, by law, having (the State), as its apparent purpose, to improve its finances by cutting its expenditure relating to officials, civil servants and pensioners in the public and wider public sector."(1)
